TERMS AND CONDITIONS OF USE

Here are the Terms and Conditions of Use (hereinafter “Terms and Conditions”) for 30SEC.MU, an intuitive musical discovery platform (hereinafter “Platform”) developed by L’Oreille Production Inc. (hereinafter “Enterprise”).

CONTEXT AND TERMINOLOGY

• As an internet user of our Platform, we will refer to you as “User” in the following text.

• The music you will discover with our Platform are “works” as defined by the Copyright Act of Canada.

• These works are written, composed, performed and recorded by “Assignees”.

• These Assignees have chosen to trust our Enterprise to represent their works, so Users like you may synchronize them to their audiovisual projects, according to the conditions set forth by a “License to Use”, the validity of which is conditional upon its full payment by the User.

USER RIGHTS FOR MUSIC

The works represented and distributed via our Platform are protected by copyright. Any commercial or public use of one of the works listed on our Platform - without previously having obtained a valid License to Use from our Enterprise - constitutes copyright violation and is punishable by prosecution in a court of law without further notice.

LIMITATION OF LIABILITY

By using the Platform, the User agrees to adhere to the present Terms and Conditions. The Enterprise reserves its right to rescind without prior notice access to its Platform from any User not complying with its Terms and Conditions and/or the conditions of any License to Use that would be granted to said User.

The Platform offers access to a catalogue of works of which the right to represent has been legally acquired by the Enterprise from the respective Assignees. The legality of the sound recordings and musical works listed on the Platform is duly guaranteed by the Assignees. As such, all Assignees represented herein have previously declared - in good faith - that their works are original, without sound samples that may violate any third party’s copyright. That said, our Enterprise is not personally responsible for any loss or damage that may result from any false declaration by the Assignees represented herein.

Our Enterprise is not responsible for: i) any virus that may be transmitted by files shared between our Platform and any User; ii) any loss of data or any loss of revenue resulting from such loss of data. Furthermore, our Enterprise fully dissociates itself from the content of works that could be, as the case may be, offensive, defamatory, heinous or violent.

DELIVERY POLICY

Subsequent to the issuance of a License to Use, a download link of the work requested (in WAV format, “Broadcast” quality) will be sent to the User so he/she may complete his/her audiovisual project. The User will therefore be able to use the work according to the terms and conditions of the License to Use granted by the Enterprise in the name of the Assignees and/or directly from the Assignees.

REFUND POLICY

No refund or exchange will be possible after the License to Use has been received and payment in full of said License to Use has been processed.

CONFIDENTIALITY POLICY

Any personal information given by the User to our Enterprise during the transaction will be kept in a safe and secure place. Our Enterprise reserves its right to communicate with any Platform User to inform him/her of its news or promotions. An unsubscribe link will appear at the end of each email sent to the User. Furthermore, our Enterprise reserves its right to communicate at any time by email with the User, and this only for administrative purposes.

BREACH OF COPYRIGHT

If you believe that any content listed on 30SEC.MU’s Platform is in breach of anyone’s copyright, please inform us of this at legal@30sec.mu to allow us to determine if there is any potential copyright violation and, if need be, to remove any content that may be subject to copyright violation.
